{"id":19633,"date":"2024-10-07T09:57:21","date_gmt":"2024-10-07T07:57:21","guid":{"rendered":"https:\/\/feral.law\/?post_type=publication&#038;p=19633"},"modified":"2024-11-26T17:07:26","modified_gmt":"2024-11-26T16:07:26","slug":"air-canada-jugee-responsable-des-informations-erronees-fournies-par-son-chatbot-a-un-passager","status":"publish","type":"publication","link":"https:\/\/feral.law\/en\/publications\/air-canada-jugee-responsable-des-informations-erronees-fournies-par-son-chatbot-a-un-passager\/","title":{"rendered":"Air Canada jug\u00e9e responsable des informations erron\u00e9es fournies par son chatbot \u00e0 un passager"},"content":{"rendered":"\n<p><strong><em>Dans une d\u00e9cision en date du 14 f\u00e9vrier 2024, le juge canadien a condamn\u00e9 Air Canada \u00e0 indemniser un consommateur du pr\u00e9judice subi en lien avec des informations incorrectes fournies par son chatbot.&nbsp;&nbsp;<\/em><\/strong><\/p>\n\n\n\n<p>\u00c0 la suite du d\u00e9c\u00e8s de sa grand-m\u00e8re survenu en novembre 2022, un internaute a r\u00e9serv\u00e9 deux vols aupr\u00e8s d\u2019Air Canada.&nbsp;<\/p>\n\n\n\n<p>Lors de sa navigation, l\u2019internaute a interrog\u00e9 le chabot du site web de la compagnie a\u00e9rienne pour obtenir des informations sur les modalit\u00e9s d\u2019application des tarifs pr\u00e9f\u00e9rentiels en cas de voyage li\u00e9 \u00e0 un deuil familial (\u00ab&nbsp;<em>bereavement fare&nbsp;\u00bb)<\/em>.&nbsp;<\/p>\n\n\n\n<p>Le chatbot a r\u00e9pondu au client qu\u2019il pouvait b\u00e9n\u00e9ficier de mani\u00e8re r\u00e9troactive du tarif r\u00e9duit en cas de deuil familial en soumettant sa demande de remboursement partiel dans les 90 jours suivant l\u2019achat du billet.&nbsp;<\/p>\n\n\n\n<p>Quelques jours apr\u00e8s son voyage, le client a recontact\u00e9 Air Canada aux fins de soumettre sa demande de remboursement et b\u00e9n\u00e9ficier du tarif r\u00e9duit. Se trouvant encore dans le d\u00e9lai de 90 jours indiqu\u00e9 par le chatbot, le consommateur fournissait \u00e0 l\u2019appui de sa demande le certificat de d\u00e9c\u00e8s de sa grand-m\u00e8re, le formulaire de demande de remboursement ainsi que les captures \u00e9cran de sa conversation avec le chatbot.<\/p>\n\n\n\n<p>Apr\u00e8s plusieurs \u00e9changes de courriels, Air Canada a refus\u00e9 de faire droit \u00e0 la demande du consommateur au motif que les informations fournies par le chatbot ne correspondaient pas \u00e0 sa politique tarifaire.&nbsp;<\/p>\n\n\n\n<p>Le consommateur a saisi le juge civil canadien (\u00ab&nbsp;Civil Resolution Tribunal&nbsp;\u00bb) aux fins de voir la compagnie a\u00e9rienne condamn\u00e9e au paiement de dommages et int\u00e9r\u00eats.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sur la responsabilit\u00e9 d\u2019Air Canada quant aux d\u00e9clarations inexactes de son chatbot (\u00ab&nbsp;negligent misrepresentations&nbsp;\u00bb)<\/h3>\n\n\n\n<p>Pour sa d\u00e9fense, Air Canada tentait de faire valoir qu\u2019une entreprise ne pouvait \u00eatre responsable des all\u00e9gations tenues par son chatbot et qu\u2019il appartenait au client de rev\u00e9rifier les informations fournies par cet outil.&nbsp;<\/p>\n\n\n\n<p>Air Canada soutenait notamment que dans sa r\u00e9ponse, le chatbot avait fourni au consommateur le lien vers la politique tarifaire applicable, ce qui aurait d\u00fb permettre au client de constater que l\u2019information fournie par l\u2019outil \u00e9tait erron\u00e9e.&nbsp;<\/p>\n\n\n\n<p>Le juge civil canadien n\u2019a pas retenu cet argumentaire en consid\u00e9rant que le consommateur pouvait raisonnablement s\u2019attendre \u00e0 ce que les informations fournies par le chatbot soient exactes.&nbsp;<\/p>\n\n\n\n<p>En somme, les juges ont consid\u00e9r\u00e9 qu\u2019Air Canada demeurait responsable des informations publi\u00e9es sur son site internet, que celles-ci figurent sur une page web ou dans le chatbot<sup><a href=\"#20241004nbp1\">[1]<\/a><\/sup>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sur la r\u00e9paration du pr\u00e9judice subi par le consommateur&nbsp;<\/h3>\n\n\n\n<p>Le juge canadien a estim\u00e9 que le consommateur avait subi un pr\u00e9judice financier et que l\u2019indemnisation allou\u00e9e devait correspondre au montant qu\u2019il aurait d\u00fb percevoir s\u2019il avait b\u00e9n\u00e9fici\u00e9 du tarif r\u00e9duit applicable.&nbsp;<\/p>\n\n\n\n<p>Autrement dit, les juges ont consid\u00e9r\u00e9 que le consommateur devait \u00eatre replac\u00e9 dans la situation qui aurait \u00e9t\u00e9 la sienne si le chatbot n\u2019avait pas fourni d\u2019information erron\u00e9e<sup><a href=\"#20241004nbp2\">[2]<\/a><\/sup>.<\/p>\n\n\n\n<p>Air Canada a ainsi \u00e9t\u00e9 condamn\u00e9e \u00e0 payer au passager la somme de 650.88 dollars canadien au titre de son pr\u00e9judice financier, en sus des frais proc\u00e9duraux support\u00e9s par ce dernier (correspondant \u00e0 la somme de 125 dollars).&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">En synth\u00e8se, il convient de retenir de ce jugement que&nbsp;:<\/h3>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>au regard du droit canadien, une entreprise peut \u00eatre tenue responsable des informations inexactes fournies par son chatbot au consommateur ;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les fausses d\u00e9clarations d\u2019un chatbot peuvent causer un pr\u00e9judice, notamment financier, au consommateur.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><em>Lire le jugement rendu par le \u00ab&nbsp;Civil Resolution Tribunal&nbsp;\u00bb le 14 f\u00e9vrier 2024,&nbsp;<\/em><a href=\"https:\/\/www.canlii.org\/en\/bc\/bccrt\/doc\/2024\/2024bccrt149\/2024bccrt149.html\"><em>SC-2023-005609<\/em><\/a><em>&nbsp;&nbsp;<\/em><\/p>\n\n\n\n<p><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<p><\/p>\n\n\n\n<p id=\"20241004nbp1\"><sup>[1]<\/sup>&nbsp;\u00ab&nbsp;<em>While a chatbot has an interactive component it is still just a part of Air Canada\u2019s website. It should be obvious to Air Canada that it is responsible for all the information on its website. It makes no difference wither the information comes from a static page or a chatbo<\/em>t \u00bb&nbsp;(\u00a727).<\/p>\n\n\n\n<p id=\"20241004nbp2\"><sup>[2]<\/sup>&nbsp;\u00ab&nbsp;<em>M. Moffat is entilted to be put in the position they would have been in if the misrepresentation had not been made<\/em>&nbsp;\u00bb (\u00a7 33).<\/p>\n\n\n\n<p><\/p>\n\n\n\n<hr
